Separation Pay Determination Guidance in Conjunction With Administrative Separation (ADSEP) Process

This MARADMIN updates procedures for determining separation pay eligibility for Marines undergoing administrative separation (ADSEP). It cancels MARADMIN 141/03 and clarifies that CMC (MMEA) is responsible for all separation pay determinations, requiring Marines with 6-18 years of service who involuntarily separate to submit a RELM request through their Command Career Retention Specialist for separation pay determination.

1. REF D IS HEREBY CANCELLED DUE TO UPDATE OF
PROCEDURES CONTAINED WITHIN THIS MARADMIN. CMC (MMEA) IS RESPONSIBLE
FOR ALL SEPARATION PAY DETERMINATIONS IN CONJUNCTION WITH DENIAL OF
FURTHER SERVICE AND ADSEP.
2. MARINES SEPARATED UNDER OTHER THAN HONORABLE CONDITIONS OR BY
REASON OF MISCONDUCT, UNSATISFACTORY PERFORMANCE OF DUTY, OR
HOMOSEXUAL CONDUCT (THAT INVOLVES AGGRAVATING FACTORS LISTED IN REF
B, PARA 6207.5) ARE NOT ELIGIBLE FOR SEPARATION PAY. MARINES THAT
FALL UNDER THIS CATEGORY ARE NO LONGER REQUIRED TO SUBMIT A RELM
REQUEST TO CMC (MMEA-6) PER REF D.
3. MARINES BETWEEN 6 AND 18 YEARS OF SERVICE WHO INVOLUNTARILY
SEPARATE ARE REQUIRED TO SUBMIT A REENLISTMENT, EXTENSION, LATERAL
MOVE (RELM) REQUEST TO CMC (MMEA-6) VIA THE COMMAND CAREER RETENTION
SPECIALIST (CRS) PRIOR TO SEPARATION FROM THE MARINE CORPS PER REFS
A AND C. IN SUCH CASES, IT IS THE RESPONSIBILITY OF THE COMMAND TO
ENSURE A RELM IS SUBMITTED ON THE MARINE'S BEHALF.
4. THE RELM REQUEST WILL BE SUBMITTED FOR SEPARATION PAY
DETERMINATION ONLY. THIS REQUEST SHOULD INCLUDE THE REASON(S) FOR
ADSEP PROCEEDINGS AND A RECOMMENDATION FROM THE COMMANDER OR
ADMINISTRATIVE SEPARATION CONVENING AUTHORITY FOR SEPARATION PAY
DETERMINATIONS (I.E. FULL, HALF, OR ZERO) AND REENLISTMENT CODE
ASSIGNMENT. IF THE MARINE'S RECORD CONTAINS INFORMATION THAT IS
HELPFUL IN MAKING THE SEPARATION PAY DETERMINATION (FULL, HALF, OR
ZERO), SUCH DOCUMENTATION SHOULD BE ATTACHED TO THE RELM IN ORDER TO
EXPEDITE THE RESPONSE.
5. CMC (MMEA-6) WILL THEN REVIEW THE REQUEST AND ADDITIONAL
INFORMATION TO DETERMINE THE SEPARATION PAY AWARD AND
REENLISTMENT CODE ASSIGNMENT. IN SUCH CASES WHERE THE ADSEP
DECISION REQUIRES THE MARINE TO SEPARATE WITHIN 20 DAYS, THE CRS IS
ENCOURAGED TO CALL CMC (MMEA-6) AND REQUEST THE DETERMINATION BE
EXPEDITED. MARINES WHO VOLUNTARILY SEPARATE PRIOR TO RECEIVING A
RESPONSE FROM CMC (MMEA) WAIVE THEIR RIGHTS TO COLLECT SEPARATIONS
PAY.
6. COMMANDS SHOULD ADVISE MARINES THAT HAVE SEPARATED WITHOUT A
SEPARATIONS PAY DETERMINATION THAT THE CORRECT COURSE OF ACTION IS
TO SUBMIT THEIR REQUEST TO THE BOARD FOR CORRECTION OF NAVAL RECORDS
PER REF B, APPENDIX D. THE APPLICATION AND SUBMISSION PROCEDURES
